If you do not want us to collect, use or disclose information about you and your use of the KnoWEwell website (“Website”) and online and mobile applications for members (referred to as the “Platform”) as described in this Privacy Policy, then you should not use the services and immediately exit the Website or Platform. By using the Website and Platform, you agree to the KnoWEwell Terms and Conditions (“Terms and Conditions”), which is the contract between KnoWEwell and you. By accepting the Terms and Conditions, you confirm that you have read and understood this Privacy Policy. This Privacy Policy does not apply to personal information collected offline and does not alter the terms of any other agreement that you may have with us.
What Information Do We Collect About You?
We may collect “Personal Information” about you when you register for membership, to update your membership or subscribe to our Platform. We do not collect any Personal Information from you unless you voluntarily provide it to us or provide us with access to it. Members (and not KnoWEwell) are solely responsible for deciding whether to share and for sharing their Personal Information with other members on the Platform. When you add information to your profile, share or post information, or follow another member on the Platform in any form, you are granting other members access to view, collect, and use that information. This may result in unsolicited messages or contact from other members. Further, if those individuals are not subject to federal, state, or other privacy laws, later disclosure by such persons may not be prohibited and/or protected by those laws. Users of the Website and members on the Platform are encouraged to exercise caution when posting Personal Information.
The Personal Information we request may depend on whether you are an individual or provider member on the Platform. For all members, such information may include your name, address(es), IP addresses, telephone number, email address, health and wellness topics of interest, and other information about your needs, values, and preferences.
If you are a provider, we also may collect information about your business such as name and address(es), including website and email address(es), business size, Employer Identification Number (EIN), contact information, primary practice information, hours of operation, insurance and other payment methods. In addition, we may collect information from providers about your professional education, licenses, certifications, professional provider organization affiliations, and professional and client/patient testimonials. For providers subject to verification of selected educational and professional information and a background check, Universal Background Screening, Inc. (“Universal”) may collect and store additional information to perform their procedures. Before consenting to the services of Universal, you should read their terms and conditions and privacy policies.
We may also collect Personal Information, such as your name and email address, when you visit our Website and request information.
How Information Collected About You Is Used?
We may use the information we collect about you to:
- Provide updates and/or administer your account;
- Provide you with access to subscribed membership features and benefits, including those features and benefits from third parties;
- Respond to your inquiries and send you administrative communications;
- Send you notices, in the form of emails and other communication modes, regarding products and services you have selected, and for billing and collection purposes;
- Complete you purchase transactions;
- Obtain your feedback on our sites and our offerings; and
- If you are a provider and have given us your consent, we also may use the information we collect about you to have Universal Background Screening, Inc. initiate a background check and credential verification procedures.
We also may use your information to improve our Website and Platform, and we may use cookies and other information to enable us to customize your experience.
How and With Whom Do We Share Your Information?
We may share the information that we have about you:
- When specifically agreed to by you;
- To our vendors and suppliers that help us provide the services to our members and to otherwise assist in the operation of the Platform;
- To comply with legal requirements, such as a statute, regulation, search warrant, subpoena, or court order;
- In response to lawful requests by public authorities, including to meet national security or law enforcement requirements;
- In the event of a corporate change in control resulting from, for example, a merger, a sale of assets, or bankruptcy;
- When we believe in good faith that disclosure is necessary to protect our rights, protect your safety or the safety of others, investigate fraud, or respond to a government request; or
- In special cases, such as in response to a physical threat to you or others.
KnoWEwell does not make your Personal Information available to third parties for their marketing purposes without your consent. When we engage third parties to perform the business-related functions, such as administering our Website and Platform, database maintenance, hosting services, and processing or collecting payments, we provide them with the information that they need to perform their specific function, which may include Personal Information. These third parties are not authorized by us to use any of your Personal Information except as needed for such specific functions.
If you use a mobile device to access the Website or Platform, your mobile carrier’s network and your carrier may have access to the request you transmit. You should consult the privacy policy of your carrier for additional information.
We reserve the right to disclose, at our discretion, any information that is requested by law enforcement agencies or if we are required to do so by applicable statute, regulation, subpoena, court order, treaty, or by a government entity. We also may disclose Personal Information to third parties if we have reason to believe that disclosing such information is necessary to conduct investigations of possible breaches of law, to cooperate in any legal investigations, or to identify, contact, or bring legal action against an individual(s) who may be violating our Terms and Conditions or any other agreement with us. We also may disclose Personal Information when we have reason to believe that someone is or may be causing injury to or interfering with our rights or property, other members, or anyone else that could be harmed by such activities. We reserve the right to disclose and transfer any information we have about you in connection with a sale, merger, consolidation, change in control, transfer of assets, reorganization, or liquidation of our business.
How Do We Track Your Use?
As you interact with our website and the Platform, we may use automatic data collection technology and services to record and collect information that identifies your computer, to track your use of the Platform, and to collect certain basic information about you. This information may include information about your operating system, your IP addresses, browser type and language, referring and exit pages and URLs, keywords, date and time, amount of time spent on particular pages, what sections of a website you visit, and other similar information concerning your use of the Platform (the “Usage Information”).
We collect this Usage Information by using cookies and pixel tags (also called web beacons or clear gifs). Cookies are small packets of data that a website store on your computer’s hard drive so that your computer will “remember” information about your visit. Clear gifs are tiny graphics with a unique identifier, similar in function to cookies, and are used to track the online movements of web site members. The Usage Information is collected and used in aggregate form. We do not collect Personal Information in this way, but if you’ve provided us with Personal Information, we may associate that information with the information that is collected automatically.
Automatic data collection may be performed on our behalf by our services providers. If third parties provide such analytics services and software, the third parties may also receive the information collected and their use of such information is governed by their privacy policies.
At this time, we do not have the technological capability to respond to “Do Not Track” signals, and our website and Platform may, therefore, collect any information that an end user’s browser provides, such as information identifying the end user’s operating system and Internet protocol address.
We do not currently sell your Personal Information to third parties.
What Are Your California Privacy Rights?
Pursuant to Section 1798.83 of the California Civil Code (the “Shine the Light Law”), residents of California have the right to request from a business, with whom the California resident has an established business relationship, certain information with respect to the types of personal information the business shares with third parties for direct marketing purposes by such third party and the identities of the third parties with whom the business has shared such information in the immediately preceding calendar year. We will endeavor to respond to such requests within a reasonable time by providing a report that includes the information required by applicable law. Please be advised that KnoWEwell is not required to respond to requests from any individual resident under the Shine the Light Law more frequently than once per calendar year.
How Do We Secure and Retain Your Information?
We take reasonable security measures to protect the security of your Personal Information. Despite KnoWEwell's efforts to protect your personal information, there is always some risk that an unauthorized third party may find a way around our security systems or that transmissions of your information over the Internet may be intercepted.
The security of your Personal Information is important to us. When you enter Personal Information, we encrypt the transmission of that information or use SSL connections (Secure Socket Layer) technology.
We will retain your Personal Information as long as your membership is active or needed to provide you services. At any time, you can remove your Personal Information or instruct us to remove it, but you should be aware that it is not technologically possible to remove each and every record of the information you have provided to KnoWEwell from our servers. KnoWEwell tools that collect and store Personal Information allow you to correct, update, or review the information you have submitted by going back to the specific tool, logging in, and making the desired changes. We also will retain your Personal Information as necessary to comply with legal obligations, resolve disputes, and enforce our agreements.
We utilize PCI compliant payment processing and do not retain personal payment data.
What Choices Do You Have About Your Information?
If you do not want your Personal Information used by KnoWEwell as provided in this Privacy Policy, you should not subscribe or register to the Website or become a member on the Platform.
How do You Update or Remove Your Information?
If you do not want your Personal Information used by KnoWEwell as provided in this Privacy Policy, you should not register as a member or for any specific tool or application that collects Personal Information. You can correct, update, or review Personal Information you have previously submitted by going back to the specific tool or application, logging in, and making the desired change. You can also update any Personal Information you have submitted by contacting us using the contact information listed below.
If you have registered and/or joined as a member and desire to delete any of your Personal Information you have provided to us from our systems, please contact us using the contact information listed below. Upon your request, we will use reasonable best efforts to delete your Personal Information from our active databases and where feasible from our backup media. You should be aware that it is not technologically possible to remove each and every record of the information you have provided to the KnoWEwell Platform from our servers. Once your data is removed, you will not be able to use your membership until the end of your then-current subscription term. After the information is provided to third parties, such as third parties that provided services to you through the Platform, KnoWEwell does not control that information, and you should consult the privacy policies of those third parties.
How Do You Unsubscribe?
You can “unsubscribe” to the Website and request your data to be removed from KnoWEwell at any time. KnoWEwell will use reasonable best efforts to respond and remove all requested data within 72 hours.

If you receive online newsletters or email promotional communications from KnoWEwell, you may “unsubscribe” from receiving these communications from us by following the instructions at the bottom of the email. Your decision to opt-out of receiving promotional and marketing materials from us will not preclude us from corresponding with you regarding your existing or past business relationship with us, and will not preclude us from accessing and viewing your Personal Information in course of maintaining and improving our Website, Platform, and services.

We reserve the right to change or modify this Privacy Policy or any of our tools or services at any time and any changes will be effective upon being posted unless we advise otherwise. Your continued use of the Website or Platform after changes are posted will constitute your agreement to and acceptance of such changes. We may treat information collected through the Website and Platform in accordance with the revised Privacy Policy, including information previously collected. We encourage you to periodically review the Platform for the latest information on our privacy practices. If you do not accept the terms of the revised Privacy Policy, do not use the Website or Platform.
Note to Users Outside of the United States of America
KnoWEwell is located in the United States of America. In order to provide services, the Personal Information that you provide to us is processed through and stored on secured servers located inside and outside of the United States of America. By subscribing, registering as a member or using the Platform, you consent to such collection, storage and processing in the United States of America and elsewhere, though the United States of America and other jurisdictions may not afford the same level of data protection as considered adequate in your own country. We will take reasonable steps to protect your personal information. Note that your personal information may be available to the government of the United States of America or its agencies under legal process made in the United States of America.
